Streamlined Estate Administration and Probate in New Jersey
Understanding Probate and Estate Administration
Probate in New Jersey is the process of arranging for the executor named in a will to qualify to handle the estate – – or for an administrator to be appointed if there is no will.
The county surrogate processes wills, with minimal court involvement, while estate administration without a will requires an appointed administrator and usually a surety bond.
Estate administration is often mentioned as part of probate because in some states the court system monitors some, if not all, of the management of a deceased person’s estate, including asset collection, debt settlement, tax payments, and asset distribution. In New Jersey, estate administration is not supervised by the Surrogate or the court system unless there are problems. If everything goes smoothly, the executor can close the estate by filing documents with the surrogate. Occasionally, in order for the executor or administrator to close an estate, it is necessary to submit an accounting for review by the Surrogate. This is necessary only when there is a problem because one or more beneficiaries do not agree with the manner in which the executor or administrator has handled the estate.

Navigating Contested Probate Litigation
Probate disputes usually arise from perceived unfair distributions. We aim for negotiated resolutions but provide robust advocacy when needed.
